If you access a Peoplepages iAgent
Search system or our web site you agree to be bound by these
terms and conditions.
1)
GENERAL
Peoplepages provides interactive 'plugins' for its customers, and in
some cases web hosting through a partner organisation.
Peoplepages reserves the right to suspend or cancel a customer's access
to any or all services provided by Peoplepages and its partners when
Peoplepages decides that the account has been inappropriately used or
otherwise.
2)
SERVER USE
Peoplepages do not allow any of the following content to
be stored on its servers: Illegal Material - This includes
copyrighted works, commercial
audio, video, or music files, and any material in violation of any
Federal, State or Local regulation. Adult Material - Includes all pornography,
erotic images, or otherwise lewd or obscene content. The designation
of "adult material" is left entirely to the discretion of Peoplepages.
3)
PAYMENT POLICIES
All accounts are set up on a prepay basis. Although Peoplepages reserves
the right to change prices of accounts or services at any time all
pricing is guaranteed for the period of prepayment. Payment is due
each quarter or month following the date the account was established.
Customers will automatically be invoiced/charged again at the end of their
prepay period unless closure notification has already been given. The customer
or reseller is responsible for all money owed on the account from the time
it was established to the time that the customer sends a written cancellation
request. Where an account is held through the Peoplepages Reseller Scheme
(PPRS) the reseller is deemed to be the customer and liable for all money
owed on the account.
4)
PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down Peoplepages
runs a limited number of payment options.
Cheque Payment: This option is only available to customers who
pay quarterly in advance for their Peoplepages account. Peoplepages cannot
guarantee that a service will be provided until after any received cheques
have been cleared.
Direct Debit: This option is available to customers by agreement
only for payment on a monthly basis in advance for their Peoplepages
account. Peoplepages cannot guarantee that a service will be provided
until the appropriate payment has been received in our bank account after
any received cheques have been cleared. Please contact us for more details.
5)
CANCELLATION AND REFUNDS
Peoplepages reserves the right to cancel the service at any time. In this
event customers will be entitled to a pro rata refund based upon the
remaining period of membership. If a customer contravenes Peoplepages'
terms of service a refund will not be issued in the event of a cancellation. Customers
may cancel their account at any time. Any incentives offered to customers
when opening the account will also be cancelled. Customers may be given
the option to purchase services which were offered as start-up incentives
in the result of a cancellation.Fees charged
on a prepay basis are non-refundable. Customers are not entitled to
receive a refund unless the service is cancelled by Peoplepages. In
addition some accounts incur set-up fees, these charges are also non-refundable.
6)
INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold Peoplepages
harmless from any and all demands, liabilities, losses, costs and claims,
including reasonable attorney's fees asserted against Peoplepages,
its agents, its customers, officers and employees, that may arise or
result from any service provided or performed or agreed to be performed
or any product sold by customer, its agents, employees or assigns.
Customer agrees to defend, indemnify and hold harmless Peoplepages against
liabilities arising out of; (1) any injury to person or property caused
by any products sold or otherwise distributed in connection with Peoplepages'
server; (2) any material supplied by customer infringing or allegedly infringing
on the proprietary rights of a third party; (3) copyright infringement
and (4) any defective products sold to customer from Peoplepages' server.

INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights in Peoplepages iAgent systems and web
site and the information contained on them are owned by Peoplepages
Limited and no part of them may be copied, reproduced, redistributed
or retransmitted without the written permission of Peoplepages. The
user agrees not to and not to permit anyone to use the information
provided through Peoplepages iAgent systems or web site for any unlawful
or unauthorised purpose.

DISCLAIMER
Peoplepages will not be responsible for any damages your business may
suffer. Peoplepages makes no warranties of any kind, expressed or
implied for services we provide. Peoplepages disclaims any warranty
or merchantability or fitness for a particular purpose. The includes
loss of data resulting from delays, nondeliveries, wrong delivery,
and any and all service interruptions caused by Peoplepages and its
employees. Peoplepages reserves the right to revise its policies
at any time. Peoplepages has made iAgent products available
to assist users to identify goods and services for sale
and to purchase and sell goods and services to each other.
Peoplepages cannot be involved in confirming the accuracy
of the information available on iAgent applications and
cannot guarantee the completeness or accuracy of any
such information. Peoplepages makes no claims concerning
the validity or exactness of the information and no warranty,
term, condition, express or implied, statutory or otherwise
, as to the condition, quality, performance or fitness
for purpose or accuracy of the iAgent systems and all
such warranties, terms and conditions are hereby excluded
save to the extent such exclusion is prohibited by law.
The liability of Peoplepages in respect of any loss or
damage suffered as a result of the use of any of its
systems shall be limited to the value of the charges
paid by the user for access to and use of the the iAgent
products and except for loss up to that limit Peoplepages
shall have no liability for indirect and consequential
loss, loss of profit, goodwill, loss of business, and
economic loss.
9)
LEGAL JURISDICTION
These terms and conditions shall be governed by and construed in accordance
with English law and the Court of England shall have jurisdiction
over any dispute arising in relation to them.
